Trump Seeks Supreme Court Clearance for National Guard Forces in Chicago Area
On Friday, the administration petitioned urgently to the nation's highest court, seeking clearance to send national guard forces to the state of Illinois.
This move is part of a broader push to increase the internal deployment of the armed forces in multiple cities run by Democrats.
Court Fight Over Guard Activation
In an immediate request, the US Department of Justice asked the court to overturn a lower court ruling that had stopped the deployment of several hundred military reserve members to the Chicago area.
The federal judge had raised doubts about the government's reasoning for deploying forces, doubting its reasoning in considering local conditions.
A appellate court upheld the initial ruling on Thursday, maintaining the deployment on pause while the legal challenge proceeds.
Government's Claims
The solicitor general, representing the government, stated in the new filing that federal agents have frequently been “menaced and attacked” in Chicago and the suburb of Broadview area.
This site is home to an federal immigration holding center.
The former president has already sent state guard forces to Chicago and the city of Portland, subsequent to prior deployments to Los Angeles, Memphis, and the nation's capital.
The White House has claimed that troop deployment is necessary to curb unrest and strengthen border control.
Ideological Opposition
Democratic officials have strongly opposed the move, saying that the White House's statements are overstated and politically motivated.
They accuse the administration of abusing his executive power to retaliate against critics.
Judges have also raised questions about the government's portrayal of ongoing incidents.
City officials state that protests over ICE activities have been primarily limited and calm, contradicting the administration's portrayal of “combat area” circumstances.
Statutory Grounds
At the core of the conflict is the president’s use of a national law authorizing the president to nationalize the national guard only in cases of insurrection or when “powerless with the regular forces to execute the laws of the United States”.
The White House argues that the troops are essential to defend government buildings and personnel from protesters.
Latest Events
Previously, the White House federalized 300 personnel of the Illinois national guard and commanded additional Texas-based personnel into the region.
As state authorities criticized the move, the White House increased his statements, calling on the arrest of the city's leader and the Illinois governor, the two Democratic officials, charging them of failing to secure federal agents.
Illinois and the city of Chicago filed a combined lawsuit the White House to stop the activation.
On October 9, Judge April Perry, a Biden appointee, handed down a preliminary order blocking the command.
Local Events
Simultaneously in the city, at least 11 people were arrested outside the Broadview Ice detention center following serious disputes between Illinois state police and activists.
